When the 2018 Farm Bill legalized hemp and CBD nationwide, it signaled sweeping reforms across the country. CBD became legal nearly overnight. Americans everywhere now had access to CBD. Not only that, they could now travel easily from state to state with CBD free from worry.

It would be nice if that were really the case.

In fact, there are several factors to keep in mind when traveling with CBD. From protecting your CBD from the TSA to avoiding potentially harmful legal ramifications, here are some helpful tips regarding traveling with CBD.

Air Travel Tips

Air travel is beginning to rebound as more travelers are vaccinated and looking to get away. And chances are, if you use CBD, you’re going to want to bring it with you when you travel. Below, we’ll outline two crucial rules for flying with CBD oil, tincture, vape juice, and more.

Flying With CBD

If you’ve got a flight coming up, you may be asking yourself, “can I take CBD on the plane?” Fear not! You can, in fact, take CBD on a plane. That includes both in your carry-on and in a checked bag. But there is one caveat, though.

According to TSA rules, travelers may bring any CBD product with less than 0.3% THC on a flight. However, that shouldn’t be a problem for most travelers since any CBD product already needs to be less than 0.3% THC to be legal under the Farm Bill.

However, this could affect travelers who are medical patients or reside in states with recreational cannabis. For example, if one of these travelers purchased a CBD-infused product at one of their state’s dispensaries that has more than 0.3% THC, they can’t bring it on a plane with them.

Bear in mind that according to the TSA’s own policies, they don’t search for personal amounts of illegal drugs. So they’ll only become a problem if the TSA finds them while searching your bag for something dangerous.

Remember TSA Volume Restrictions

Okay, so we’ve established that the TSA allows travelers to bring CBD on a plane. However, there is a TSA regulation that could affect CBD products: the rule about liquids. TSA regulation that could affect CBD products: their rule about liquids.

The TSA won’t let you on a plane if you have a liquid in a bottle larger than 3.4 ounces (100 ml) in your carry-on. That includes liquid CBD products like tinctures or infused drinks. What’s more, if you have multiple containers, they all need to fit into a 1 quart-sized plastic bag.

You can bypass these volume restrictions by placing your CBD in your checked bag. But if you have a long flight or layover, you won’t have access to your CBD. So just keep that in mind when packing your bags!

Don’t Travel with CBD to These States

There’s one more significant fact to keep in mind for anyone asking, “can you travel with CBD oil.” And while this shouldn’t be an issue, unfortunately, it is.

Although CBD may be legal at a national level, certain states have taken it upon themselves to enact stricter CBD laws than the federal government. In fact, three states in the US have forbidden CBD use among their citizens. What’s more, they’ve even made traveling with CBD illegal for out-of-state visitors.

These states include:

Iowa: state law prohibits possession of CBD within Iowa’s borders. It’s curious since you’d think such an agricultural state would jump at the opportunity to cultivate industrial hemp. But, in a strange twist, the state does allow patients suffering from certain medical conditions to apply for a medical CBD card. No, we’re not kidding.
South Dakota: of all the states where CBD is illegal, this might be the most frustrating one. In a push to legalize CBD and hemp in South Dakota, House Bill 1191 passed both the state’s House and Senate only to be vetoed by Governor Kristi Noem.
In fact, Governor Noem specifically stated that “no industrial hemp will cross into South Dakota,” and indicated the same for CBD. So steer clear of South Dakota with your CBD.
Idaho: here’s a state with some tricky CBD laws. In Idaho, no one may possess a CBD product if it contains any THC at all. That means the state even prohibits products that contain 0.3% THC, which federal law legalizes. Luckily for Idaho residents and visitors, Relive Everyday has your backs.
